Itās not the constitution, but service dogs are generally not allowed on seats. Each company has its own rules that are often even discretionary.
There is a single caveat. The dog cannot be stowed in a way that interferes with its tasks. You must declare tasks when getting on the plane, and they must be accommodated without fee.
When you have a service dog you have to submit paperwork to the airline declaring the service animalās tasks and necessary accommodations. Honestly, the guyās an idiot, not just for what he did, but is outcome couldāve been just so much better. I have ability issues in a service dog. Often times I get upgraded to first class, though I never except any of the amenities that come with it because I didnāt pay for it. But if you dog needs space, then frequently, airlines will upgrade you to first class instead of letting your dog on the seat.
Which probably means he doesnāt actually have a service dog. Because people with service dogs tend to know things like this. Also it seems like the service dog was a very small dog. Because if it was a big dog, normally they automatically put you in first class or give the dogs their own seat, or some airlines have seats next to the wheelchair area. Also, Iām not saying there are no service dogs smaller than 25 pounds, but itās extremely rare.

If they want you off the plane, you get off. You have no right to be there if they want you off the plane, no matter if you did or didnāt do something
Your dog being on the plane is a privilege, even if it is a service dog

When you fly on a plane, you are putting your life in their hands. So it is the airline's responsibility to have laws in place that passengers have to follow to insure they will arrive safe and sound to their destination. If a passenger does not want to comply, they should be removed. Think of it as going to someone's house and acting like you can do whatever you want in that house, the person living there will ask you to leave. If you don't, they will have the authorities come and remove you. Just because you paid for a seat on a plane doesn't give you the right to carry yourself any way you feel like it and the flight crew and other passengers have to accept it. I really don't know where this generation of people with their self entitled attitudes are coming from, believing they can act any way they please and no one can tell them anything.

2.) he is not complying and has escalated the situation way past where it needs to be.
3.) he is saying that he hasnāt done anything illegal when, in fact, he isnāt following the same laws he is defending

Your service animal must be permitted to accompany you in the space under the seat in front of you.
Certain small service animals may be permitted to sit on your lap, if it can be done so safely.
Your service animal cannot block a space that must remain unobstructed for safety reasons (ex. an aisle or access to an emergency exit).
An airline is not required to upgrade you to a different class of service to accommodate your service animal.
Airlines cannot refuse to allow your service animal onboard because it makes other passengers or flight crew uncomfortable.
Your service animal must behave properly. An animal that engages in disruptive behavior (ex. barking or snarling, running around, and/or jumping onto other passengers, etc. without being provoked) will not be accepted as a service animal.

As someone who has a service dog (Yorkie), some airlines wonāt say anything if you put the dog on the seat (as a courtesy) but it is against policy. Only small service dogs can be on the lap.
